Intellectual Property Rights

All intellectual property rights including, but not limited to; concepts, proposals, layouts, designs, style, typography, colour schemes & flowcharts, are reserved and remain the property of or return to TOTLD while any past, present or future invoices are outstanding and/or full and final payment has been received. If a project is yet to be commissioned or a purchase order has not been received by TOTLD, all intellectual property rights remain the sole property of TOTLD Design.

Title of Ownership

Title of ownership of, but not limited to; concepts, proposals, layouts, designs style, typography, colour schemes, flowcharts, websites, online applications, digital media, print materials remain/return to TOTLD while any past, present or future invoices are outstanding and full and final payment has been received. If a project is yet to be commissioned or a purchase order has not been received by TOTLD, title of ownership remains the sole property of TOTLD Design.

Working Files

Working files are the sole property of TOTLD Design. The working files are the blueprint by which TOTLD Design create client work, but the final artwork is what the client is purchasing, not the blueprint. Working files may be purchased from TOTLD Design at a discussed fee.

Disclaimer

Any suggestion, allusion, reference, mention, promise, guarantee or indication relating to price, cost, quotation, estimate or timescale contained in any electronic communication is not binding or guaranteed unless supplied by a director of TOTLD Design in a company quote PDF. The author of the electronic communication does not make any representation or warranty, expressed or implied, as to the information’s accuracy or completeness.

Virus Protection

While every effort is made to scan for and remove viruses from all incoming and outgoing electronic communications care should be taken opening any email or attachment. TOTLD recommends that all recipients have up-to-date anti-virus software installed and correctly configured on their computer.

Liability

TOTLD accept no liability for any damage or loss of earnings howsoever caused by receiving an electronic communication with or without attachments whether the communication was requested or not.

Changes to these statements will occur from time to time. Amendments will be included in relevant sections and dated. Any emails sent on or after the date shown in the amendment are subject to the updates made to any terms and disclaimers.
